Abstract

Examines the Outer House ruling in Anderson v Imrie, a damages action for serious skull and brain injuries suffered by a child when a gate fell on him during a visit to the defenders' farm. Details the court's assessment of the appropriate level of supervision, whether the defenders failed to take reasonable care for his safety under the Occupiers' Liability (Scotland) Act 1960 s.2(1), and its findings on contributory negligence.
