Abstract

This article explores the complex question of how the limited resources at the disposal of a public authority are relevant to the availability of remedies in judicial review. It focuses on recent decisions in the context of the long-running housing crisis, particularly Elkundi, to explore how the courts are grappling with this question in ways that are putting orthodox principles of public law under strain.
