Abstract

Discusses the apparent incompatibility between interpretations of the UN Convention on the Rights of Persons with Disabilities 2006, the European Convention on Human Rights 1950, and English law. Highlights inconsistencies with arts 12 and 14 of the 2006 Convention. Considers various legal aspects that result from such disparencies including potential conflicts in the interpretation of provisions that protect the same or similar rights, and in term of aspects of the treaties based on differing premises which are problematic to reconcile.
