Abstract

Asks questions concerning the courts' practical application of the Ogden reduction factors for contingencies other than mortality. Discusses topics including the quality of the data used to calculate the disability-adjusted reduction factors, good reasons for adjusting the suggested residual earnings discount factors, the magnitude of any adjustments, research into the extent of the "disability" suffered by those meeting the definition under the Equality Act 2010 and the role of employment history in adjusting pre-injury reduction factors.
