Abstract

The children of famous parents have the same rights of privacy as other children. It may, therefore, be actionable to take and publish a photograph of a child who is accompanying his or her parents when they are walking down the street (or popping out for a bottle of milk). Since the determination of whether a particular candid photograph falls within a person's expectation of privacy is a question of fact, there are no classes of activity which are automatically permitted or prohibited.
